The court found that the Respondent was neither the holder of a grant of representation nor a person entitled to a grant under section 66 of the Law of Succession Act. The Respondent failed to demonstrate any legal capacity or interest in the estate of Ndeto Mutwika, as she was not related to the deceased, had not obtained a grant for her own deceased husband, and had not established that she or her husband were creditors of the estate. The law is clear that only the holder of a grant of representation may apply for confirmation of grant, and the Respondent's summons was therefore improperly before the court.
