The Petitioner was aware of the sale and nonetheless included the property in the estate and obtained title through the grant. The court relied on the prior judgment in Machakos HCCC No. 91 of 2007, which held that the Petitioner’s title was impeachable on grounds of fraud and trust, and that the applicants were the rightful possessors of the property.
