The court found that the sale agreements between the deceased and the 1st and 2nd respondents were void for lack of Land Control Board consent, and thus the respondents were only entitled to a refund of the purchase price, not land. The inclusion of the 1st and 2nd respondents as beneficiaries in the confirmed grant was fraudulent and contrary to the judgment and review ruling in SRMCC No. 199 of 2006. The Magistrate's Court lacked jurisdiction to entertain the succession cause as the value of the estate exceeded its statutory limit, rendering the proceedings, judgment, and grant a nullity.
