As such, the Suit Land ceased to be part of the free property of the deceased's estate and could not be distributed as part of the succession proceedings. Consequently, the protest by the petitioner was upheld, the earlier grant was revoked, and a fresh grant was issued and confirmed in favour of the petitioner, Christine Kajuju Mwenda.
