The 2nd and 3rd respondents were properly included as beneficiaries, as evidenced by the succession documents. The alleged excluded beneficiaries were grandchildren of the deceased, whose mother, a direct beneficiary, survived the deceased and was provided for in the distribution. Under Kenyan succession law, grandchildren only inherit directly if their parent is deceased, which was not the case here.
