Procedural Posture

Succession Cause / Ruling on Summons for Review and Reinstatement of Cancelled Land Titles

  1. 1 Whether the probate court has jurisdiction to determine disputes relating to title and occupation of land arising from subdivisions of the deceased's estate.
  2. 2 Whether the applicants are entitled to reinstatement of cancelled land titles arising from the estate of the deceased.

Ratio Decidendi

The court held that it lacked jurisdiction to determine the applicants' claim for title to and occupation of land arising from subdivisions of the deceased's estate. The dispute, being one of land title and occupation, falls squarely within the jurisdiction of the Environment and Land Court as provided by the Constitution and land statutes. The probate court's mandate is limited to administration and distribution of the estate, not adjudication of land title disputes. Consequently, the applicants' summons for review and reinstatement of cancelled titles could not be entertained in this forum and was dismissed for want of jurisdiction.

Court Disposition

application dismissed for want of jurisdiction

Orders

  • The summons dated 1st April, 2019 by the applicants is dismissed.
