Legal Issues
- 1 Whether the Kisumu CM Succession Cause No. E050 of 2024 should be transferred to the court within the jurisdiction where the deceased was domiciled.
- 2 Whether the necessary documents, including the chief's letter and consents, must be filed before a grant can issue.
Ratio Decidendi
The court determined that since the deceased, Nyagol Andreya Oulu, was a resident of Kadongo and the estate properties are located within the jurisdiction of Maseno Law Courts, the Kisumu CM Succession Cause No. E050 of 2024 should be transferred to the Maseno SPM's Court. The court further held that the issuance of a grant is contingent upon the filing of all mandatory documents, including the chief's letter and consents. The transfer ensures that the matter is heard in the proper forum, and the parties are directed to file the necessary documents before any grant can issue.
