Procedural Posture

Miscellaneous Application / Ruling on Preliminary Objection Regarding Jurisdiction

  1. 1 Whether the High Court has jurisdiction to determine a dispute relating to ownership of land in the context of a succession cause.
  2. 2 Whether the Objector has locus standi to bring the claim under the Law of Succession.

Ratio Decidendi

The High Court lacks jurisdiction to determine disputes relating to the use, occupation, and title to land, as such matters are reserved for the Environment and Land Court under Article 162(2) of the Constitution. The Objector's claim is fundamentally about ownership of a portion of land, not a succession issue under the Law of Succession Act. The Objector is neither a child, dependant, nor creditor of the deceased, and his claim does not fall within the purview of succession proceedings. Accordingly, the High Court must stay its determination of the Summons for Revocation of Grant and direct the Objector to pursue his claim before the appropriate forum, namely the Environment and Land...

Court Disposition

Determination of the Summons for Revocation of Grant stayed pending action before the appropriate forum; High Court declines jurisdiction.

Orders

  • The determination of the Summons for Revocation of the grant dated 05/05/2010 is stayed pending further action by the Objector before an appropriate forum.
  • If the Objector does not take steps within 90 days, the stay lapses and the Petitioner may move the Court for determination or take appropriate steps.
