The court held that any purported sale or transfer of the deceased's property prior to the grant of representation and confirmation of grant is void under the Law of Succession Act. The applicants' claim to 2/3 of the land, based on a sale by Peter Matheka Nzioka before he became administrator, could not be sustained as he had no title to pass, and thus the applicants could not be bona fide purchasers for value. The doctrine of estoppel was inapplicable as the representation was not made by the estate or its administrators, and the clan meeting had no legal force to bind the estate.
