The court held that it is procedurally and legally improper to distribute the estates of multiple deceased co-owners in a single succession cause, even where the administrator is common to all. The correct approach is to first apportion the co-owned property, Samia/Budongo/370, into five equal shares corresponding to the original proprietors. Each 1/5 share should then be distributed to the beneficiaries of the respective deceased proprietor in their own succession cause. The previous confirmation orders, which lumped all five estates together, created confusion and a stalemate.
