The court held that Order 24 of the Civil Procedure Rules does not apply to succession matters, as only certain provisions of the Civil Procedure Rules are imported into the Law of Succession Act by Rule 63 of the Probate and Administration Rules, and Order 24 is not among them. Instead, the Law of Succession Act provides its own procedure for substitution of a deceased party through limited grants of representation under Paragraph 14 of the Fifth Schedule. Since no personal representative of the deceased respondent had been appointed at the time of the application, the application for substitution was incompetent.
