Legal Issues
- 1 Whether the High Court at Kisumu has jurisdiction to hear the succession cause given the location of the estate property.
- 2 Whether the cause should be transferred to the Siaya Law Courts for hearing and determination.
Ratio Decidendi
The court found that since the only asset of the deceased's estate is located within the geographical jurisdiction of Siaya, the Kisumu court lacks territorial jurisdiction to hear and determine the matter. The transfer ensures that the matter is heard and determined by the court with the appropriate territorial authority as required by law.
