The court held that section 81 of the Law of Succession Act only applies where there are multiple administrators or executors and one dies, in which case the powers vest in the survivors. In this case, the deceased administrator was the sole administrator, and upon her death, the grant became inoperative. The applicant, being a beneficiary and not previously an administrator, cannot assume administration by way of a vesting order. The proper procedure is for the applicant to seek revocation of the previous grant and then apply for appointment as administrator, subject to the court's assessment of his competence and locus standi.
