Ratio Decidendi

The court found that the grant issued to Simon Orwa Ooke had become inoperational and useless because the petitioner failed to apply for its confirmation as required by law. The grant could not be used to transfer any property of the deceased, rendering it ineffective. Consequently, the court exercised its discretion under section 76 of the Law of Succession Act to annul and revoke the grant. The petitioner is at liberty to petition for a fresh grant if so advised, but no further proceedings shall be entertained in the current file.
