The proposals for distribution by the petitioner and the objector were at variance, demonstrating uncertainty and lack of consensus. In accordance with Section 71 of the Law of Succession Act, confirmation of grant in intestate succession requires clarity and agreement on beneficiaries and their shares. The court therefore allowed the protest, struck out and dismissed the summons for confirmation of grant, and directed the parties to engage and agree on the rightful beneficiaries...
