The court found that the deceased had already disposed of his interest in the suit land to JAKIM prior to his death, and thus the land was not part of his free property subject to succession. The Petitioner/Respondent and Ambrose, despite being blood relatives, concealed this material fact when applying for the grant and certificate of confirmation. The prior civil suit (KISUMU CMCC NO. 27 OF 2011) had conclusively determined that JAKIM had purchased the land, and no appeal was filed against that decision.
