Succession Cause / Ruling on Summons for Rectification of Confirmed Grant

  1. 1 Whether the omission of Beatrice Kadenyi Mtange and Grace Kagonya Mtange from the Certificate of Confirmation of Grant constitutes an error subject to rectification under section 74 of the Law of Succession Act.
  2. 2 Whether the court should order rectification of the Certificate of Confirmation of Grant to include the omitted beneficiaries.

Ratio Decidendi

The court found that the omission of Beatrice Kadenyi Mtange and Grace Kagonya Mtange from the Certificate of Confirmation of Grant was an error, as both were listed as beneficiaries in the affidavit supporting the summons for confirmation of grant and the application was signed by all administrators. Section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules empower the court to rectify such errors in the grant. The court, satisfied that the error was demonstrated and the application was unopposed, allowed the summons and ordered rectification of the Certificate of Confirmation of Grant to include the omitted beneficiaries.
