Ratio Decidendi

The court found that the applicant, as the sole beneficiary of the estate, had inadvertently omitted two parcels of land from the schedule attached to the certificate of confirmation of grant. There being no objection to the application, and in the interests of justice and proper administration of the estate, the court exercised its discretion to review and set aside the previous confirmation of grant and substitute it with an order confirming the grant with the rectified schedule, including the omitted parcels. The court directed that a rectified certificate of confirmation of grant issue forthwith and closed the file subject to Section 83 of the Law of Succession Act.
