Procedural Posture

Succession Cause / Ruling on Application for Review of Revocation of Grant

  1. 1 Whether the discovery of a draft will after revocation of grant justifies review of the court's order.
  2. 2 Whether LR Kisumu Municipality Block7/183 forms part of the deceased's estate for distribution.

Ratio Decidendi

The court found that the draft will discovered by the applicant does not constitute a valid will under Section 11 of the Law of Succession Act, as it lacks the necessary formalities such as proper execution and attestation by competent witnesses. Therefore, its discovery does not meet the threshold for review of the court's previous order revoking the grant. Additionally, the court determined that LR Kisumu Municipality Block7/183 is not part of the deceased's estate as it remains registered in the name of the parties' late father, Christopher Obuga Opanga, and can only be distributed in his succession cause. As a result, the application for review was dismissed for lack of merit.

Court Disposition

Application for review dismissed with costs to the respondent.

Orders

  • The chamber summons dated 26.08.2020 filed on 07.09.2020 is dismissed.
  • Costs awarded to the respondent/objector.
