The court held that while section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules limit rectification to errors in names and descriptions, the inclusion of a previously omitted asset is a substantive change that ordinarily requires a review of the confirmation orders. However, invoking its inherent jurisdiction under Rule 73, the court found it just to allow rectification in this instance, as all beneficiaries had consented and the omission was apparent. The Certificate of Confirmation of Grant was ordered to be rectified to include the 36,597 Ordinary Shares at Old Mutual Insurance Company Limited, to be shared equally between the applicants.
