Procedural Posture

Succession Cause / Ruling on Notice of Withdrawal of Petition

  1. 1 Whether the petitioners have the right to withdraw the petition for letters of administration after revocation of the grant.
  2. 2 Whether the petitioners retain locus standi to act in relation to the estate after the grant was revoked.
  3. 3 Whether the notice of withdrawal is competent in the absence of a valid petition.

Ratio Decidendi

The court found that the grant of letters of administration had already been revoked by the Court of Appeal, thereby stripping the petitioners of any legal standing to act in relation to the estate. As a result, there was no valid petition remaining for the petitioners to withdraw. The notice of withdrawal was therefore incompetent and lacked merit. The court emphasized that all parties must comply with the prior orders requiring a fresh application for grant of letters of administration, as the estate was left without administrators. The petitioners' attempt to withdraw the petition was thus dismissed, as their capacity to act had ceased with the revocation of the grant.

Court Disposition

Orders
