The court held that the preliminary objection raised by the administrators did not meet the threshold for a valid preliminary objection as it did not raise a pure point of law. The court found that the protestors' application for injunction was not dependent on the filing of a summons for confirmation of grant and that the issues raised in the protest required a substantive hearing. The preliminary objection was therefore dismissed as lacking merit. The court further directed the administrators to file and serve a summons for confirmation of grant within thirty days to facilitate the hearing of the protest.
