Ratio Decidendi

The court found that the respondent had failed to comply with a previous order to submit the original title deed for Dagoretti/Ruthimitu/587, despite being served and represented at the relevant proceedings. In light of this non-compliance, and to avoid further delay or frustration of the administration of the estate, the court held that the applicant had established sufficient cause for the orders sought. The court therefore allowed the application, permitting the Land Control Board to proceed with sub-division and transmission of the property to the beneficiaries without production of the original title deed, and ordered removal of the caution lodged against the parcel.
