Ratio Decidendi

The court held that in succession matters, leave of the High Court is required before appealing to the Court of Appeal. The applicant failed to seek leave before filing the notice of appeal, thereby moving the matter outside the jurisdiction of the High Court. As the notice of appeal initiates the appeal process, the High Court cannot subsequently grant leave. Furthermore, the implementation of the impugned ruling through the surveyor's report, which was accepted by the court and not objected to by any party, rendered the intended appeal moot. Consequently, the application for leave to appeal and for status quo orders lacked merit and was dismissed.
