The court found that Bungoma/Kamakoiwa/424 was sold by Peter Siabiri Mabakhe to Beatrice Nakhumicha Ngaira in 1976, six years before Peter's death in 1982. The sale was properly documented, consented to by the Land Control Board, and the land was subsequently registered in Beatrice's name. At the time of Peter's death, the land was not in his name nor did he have any interest in it, having transferred it absolutely to Beatrice. Consequently, the land could not legally form part of Peter's estate or, by extension, Andrew's estate.
