The applicant lacked locus standi to seek revocation of grant as he had not obtained a grant of representation for his deceased relatives, whose interests he purported to represent. The court further found that the dispute over land parcel Kisumu/Nyahera/1722, now registered in the name of Millionaire Real Estate and subsequently subdivided, fell within the exclusive jurisdiction of the Environment and Land Court. The applicant's failure to establish a consanguine relationship with the deceased and the absence of any transmissible proprietary interest further undermined his claim. Accordingly, the preliminary objection was upheld and the application struck out as incompetent.
