Procedural Posture

Succession Cause / Ruling on Summons for Rectification of Grant

  1. 1 Whether the grant of letters of administration can be rectified to correct the name of the deceased.
  2. 2 Whether the omission of a property (title No. Nyandarua/ Mawingo Salient/2619) can be rectified by way of rectification of grant.

Ratio Decidendi

The court held that rectification of a grant is limited to correcting errors in names, descriptions, or similar superficial matters as contemplated by section 74 of the Law of Succession Act and rule 43(1) of the Probate and Administration Rules. The request to correct the name of the deceased fits within this scope and is therefore allowed. However, the addition of a new asset (title No. Nyandarua/ Mawingo Salient/2619) constitutes a fundamental change to the estate and cannot be effected through rectification. Such an addition requires a substantive application for review of the orders made at confirmation of the grant, as established in In Re Estate Of Charles Kibe Karanja (Deceased)...

Court Disposition

Application allowed in part; rectification of the deceased's name granted; request to add omitted property dismissed.

Orders

  • The grant of letters of administration is rectified to correct the name of the deceased as prayed in prayer number 3.
  • The request to include title No. Nyandarua/ Mawingo Salient/2619 in the list of properties is dismissed.
