Procedural Posture

Succession Cause / Ruling on Summons for Restraining Orders and Allegations of Intermeddling

  1. 1 Whether the interested parties intermeddled with the estate of the deceased contrary to section 45 of the Law of Succession Act.
  2. 2 Whether the respondent proved her claims of intermeddling with sufficient particulars.
  3. 3 What orders should be made regarding the administration and confirmation of the grant.

Ratio Decidendi

The court found that the respondent failed to provide sufficient particulars regarding which property was rented, to whom, and for how much, as required to substantiate allegations of intermeddling under section 45 of the Law of Succession Act. The burden of proof was not discharged, and the claims were therefore not proved. The application was dismissed. The court further directed the sole surviving administrator to proceed with confirmation of the grant, as the other administrators were deceased, and set timelines for filing and responses. No order as to costs was made due to the family nature of the dispute.
