Procedural Posture

Succession Cause / Ruling on Creditor's Application to Be Recognized and Paid From Estate

  1. 1 Whether the applicant should be recognized and enjoined as a bona fide creditor to the estate of the deceased.
  2. 2 Whether the probate court has jurisdiction to determine and enforce the applicant's alleged loan claim against the estate.
  3. 3 Whether the applicant's claim is res judicata in light of previous proceedings.

Ratio Decidendi

The court found that the applicant's current claim for Kshs 2,600,000, allegedly advanced as personal loans to the deceased, was distinct from the earlier protest involving a company transaction and was therefore not res judicata. However, the court held that the probate court lacks jurisdiction to determine and enforce civil claims such as the applicant's alleged loan agreements. Such claims must be pursued in a court with proper civil jurisdiction. Consequently, the application to be recognized and paid as a creditor from the estate was dismissed.

Court Disposition

application dismissed for want of jurisdiction
