Ratio Decidendi

The court found that while the objector was the only legal wife of the deceased under statutory law, the petitioner had cohabited with the deceased for a significant period and was recognized as his wife by general repute. Although the deceased lacked capacity to contract a second marriage during the subsistence of the statutory marriage, Section 3(5) of the Law of Succession Act protects women in such unions for succession purposes. The petitioner was therefore recognized as a wife for the purposes of succession. The estate was to be distributed as if the deceased was polygamous, with the objector's house (herself and three children) forming four units and the petitioner's house...
