Procedural Posture
Succession Cause / Ruling on Summons for Removal of Administrator and Revocation of Grant
Legal Issues
- 1 Whether the grant of letters of administration should be revoked under Section 76(a) of the Law of Succession Act due to defective proceedings.
- 2 Whether the late Grace Njeri Mbugua should be removed as administrator of the estate.
Ratio Decidendi
The court found that the grant was issued to the respondent while an objection was already on record, raising a substantive defect in the proceedings as contemplated under Section 76(a) of the Law of Succession Act. Given that the grant was issued and signed by Hon. Lady Justice Chepkwony in the presence of an unresolved objection, the matter was not ripe for final determination on the merits of revocation or removal. The court therefore referred the matter to the Hon. Judge for directions on revision of the order, emphasizing the need for proper procedural compliance in succession matters to safeguard the interests of all beneficiaries and ensure the integrity of the administration process.
Court Disposition
