Procedural Posture

Succession Cause / Ruling on Objection to Grant of Probate

  1. 1 Whether the deceased had testamentary capacity at the time of making the will.
  2. 2 Whether the will was validly executed and attested in accordance with the Law of Succession Act.
  3. 3 Whether the will was procured by undue influence or under suspicious circumstances.

Court Disposition

Further inquiry ordered; final determination on validity of will deferred.

Orders

  • The two attesting witnesses to the will shall file affidavits within 7 days detailing the circumstances of attestation, including place, time, and persons present.
  • The affidavits shall explain why signatures were appended only on the second page and not the first.
