Procedural Posture

Succession Cause / Ruling on Petition for Grant of Letters of Administration

  1. 1 Whether the two petitioners are the lawful beneficiaries entitled to letters of administration for the estate of the deceased.
  2. 2 Whether the age difference between the deceased and the first administrator precludes the grant of letters of administration.

Ratio Decidendi

The court found that, despite the implausibility of the recorded age difference between the deceased and the first administrator, there was no reason to doubt the relationship between the petitioners and the deceased. The Chief's letter confirmed that the two petitioners were the sole surviving beneficiaries. Guided by section 66 of the Law of Succession Act, the court exercised its discretion to appoint the two sons as administrators of the estate, as they were entitled on intestacy and no other parties had a superior claim.

Court Disposition

Letters of administration granted to the two applicants.
