The court found, based on the uncontroverted medical report and its own observations of Swaleh Ali Hussein, that he suffers from schizophrenia and is incapable of managing his own affairs. The court held that the requirements of Section 26 of the Mental Health Act, Cap 248, had been satisfied. The applicant, being a close relative and with no evidence of any other suitable person, was deemed the appropriate person to be appointed as guardian and manager of the subject's estate. The court therefore allowed the petition and made the necessary orders for guardianship and management.
