The High Court (Probate and Administration Division) lacks jurisdiction to determine disputes relating to the use, occupation, and title to land, including the transfer of co-owned property to a third party, as such matters fall within the exclusive jurisdiction of the Environment and Land Court under Article 162(2) of the Constitution. Furthermore, the applicants, as administrators with only a limited grant ad litem and not a confirmed grant, lack the legal capacity to effect the transfer of immovable property from the estate.
