Ratio Decidendi

The court found that the applicants lacked capacity to bring the application as they were neither administrators nor beneficiaries of the property in question. Furthermore, there was insufficient proof that the Motion had been properly served on all relevant parties, particularly on the advocate currently on record for the respondent. In the interests of justice and fair hearing, the court declined to determine the application until proper service was effected. The court also ordered the transfer of the cause to the High Court at Kiambu, as the estate assets are situated there.
