Ruling
1. I have perused the directions given by Dr. D. N. Ogoti, CM on 8th July 2024 following the parties’ submissions in Kisumu CM Succession No. E580 of 2022 that the estate property value exceeds the pecuniary jurisdiction of Chief Magistrate’s Court.
2. As all parties agree that the lower court has no pecuniary jurisdiction in the Succession matter before it, I hereby transfer Kisumu CM Succession Cause No. E580 of 2022 to the High Court at Kisumu for hearing and final determination.
3. Mention on 14th November 2024 for directions on any pending issues and to enable this court peruse the file and appreciate the dispute among the parties.
4. I so order.
