Ratio Decidendi

The court held that the death of the original objector does not terminate objection proceedings in a succession cause. Since the deceased objector had already given her evidence, it was in the interest of justice to allow substitution so that the objection could be determined on its merits for the benefit of her estate. The court further allowed the addition of a second objector to ensure all relevant parties are represented. The application for substitution and addition of objectors was therefore allowed, with directions for the objectors to file and serve their witness statements within 30 days.
