Procedural Posture

Probate and Administration / Ruling on Summons for Revocation of Grant

  1. 1 Whether the grant of representation was obtained fraudulently or by concealment of material facts.
  2. 2 Whether the applicant has locus standi to seek revocation of the grant.
  3. 3 Whether erroneous information in the proceedings justifies revocation of the grant.

Ratio Decidendi

The court found that although there were some erroneous statements in the proceedings, these were attributable to the deceased's widow and did not go to the core of the matter. The errors were correctable and did not justify revocation of the grant. Furthermore, the respondent was recognized and treated as a son by the deceased and his widow, having been adopted after the loss of their children. The applicant, being a cousin and nephew of the deceased, did not have locus standi in the estate. Therefore, the application for revocation of the grant was dismissed.

Orders
