The doctrine of functus officio does not apply where the court has not perfected its order or where a review is sought on the basis of a new consent by the majority of beneficiaries. The court found that the consent presented by 99.9% of the beneficiaries was fair, inclusive, and did not offend the provisions of the Law of Succession Act.
