The court found that the mediation settlement adopted on 4th December 2019 resolved all pending applications for confirmation and revocation of grant, and thus, there were no longer any pending objection proceedings. The application dated 24th September 2020, seeking restraining orders based on the pendency of such proceedings, was therefore without foundation and academic. The court further held that any disputes arising from the transmission of property following confirmation of grant should be resolved by the Environment and Land Court, as such matters fall outside the jurisdiction of the probate court.
