The court found that the deceased, Seth Kirigwi Joseph, died testate, having left a valid written will dated 6th April 1999. The will was properly executed and witnessed in accordance with the Law of Succession Act, and there was no credible evidence of lack of testamentary capacity, undue influence, or fraud. The failure to appoint executors did not invalidate the will. The protestors' claim of an oral will failed because they could not establish the date of its making, and the deceased died more than three months after the alleged oral will, contrary to statutory requirements.
