Ratio Decidendi

The court found that the preliminary objection did not raise a pure point of law, as determining whether the subordinate court had jurisdiction required a factual enquiry into the pecuniary value of the estate. Without such an enquiry, the court could not determine if the transfer was proper. Furthermore, the court had already made a final decision on the transfer and dismissed an application for review on similar grounds, rendering it functus officio. As such, the court lacked jurisdiction to revisit the issue. The preliminary objection was therefore without merit and was dismissed. No order as to costs was made, considering the family nature of the dispute.
