Succession Cause / Ruling on Objection to Confirmation of Grant

  1. 1 Whether the objector, as a granddaughter-in-law of the deceased, is entitled to a share of the deceased's estate directly or only through her father-in-law.
  2. 2 Whether grandchildren can inherit directly from their grandparents where the parent is alive.
  3. 3 Whether the mediation agreement is binding for purposes of distribution of the estate.

Ratio Decidendi

The court held that both the petitioner and the objector, as grandchildren and granddaughter-in-law of the deceased, were not entitled to inherit directly from the deceased's estate while their father and father-in-law, Kimarta Sitonik, the deceased's son, was still alive. The Law of Succession Act and relevant case law establish that grandchildren inherit from their grandparents only through their parents, unless their parent is deceased or they were being maintained by the deceased immediately prior to death. Court Disposition

objection dismissed

Orders

  • The objection dated 24th March 2023 is dismissed.
  • The estate shall devolve to Kimarta Sitonik as the sole beneficiary.
