The Applicants failed to prove, on a balance of probabilities, that they were daughters or dependants of the deceased, Solomon Odwar Anyango. Their evidence, including a Chief's letter and oral testimony, was insufficient and uncorroborated, especially in light of direct denials and contrary evidence from the Respondent and his witnesses. The Applicants did not call the maker of the Chief's letter or provide documentary proof such as birth certificates. Furthermore, the Applicants did not establish dependency as required by Section 29 of the Law of Succession Act, since they were married long before the deceased's death and did not demonstrate maintenance by the deceased.
