Ratio Decidendi

The High Court found that there was no issue of pecuniary jurisdiction justifying the transfer of the succession cause from the lower court. The trial court should have proceeded to deliver a ruling on the application for exhumation, as the matter had been substantially handled at that level. Furthermore, the administrative process for transferring the file was not properly followed: the original file was not transferred in the system nor assigned a High Court Succession Cause Number, and proceedings cannot continue in a miscellaneous file. Consequently, the orders for transfer were set aside, the miscellaneous file closed, and the matter returned to the lower court for hearing and disposal.
