Ratio Decidendi

The court found that the Land Disputes Tribunal had no jurisdiction to determine the distribution of the deceased's estate, as its statutory mandate does not extend to matters of succession or title to land. The tribunal's award, therefore, could not be read or adopted by the court. Additionally, there was no legal basis or sufficient evidence to add the applicant as an administrator of the estate. The application was further defeated by the fact that the relevant procedural rules did not permit reliance on the cited provisions of the Civil Procedure Rules in succession matters. Consequently, the chamber summons dated 30th May 2000 was dismissed in its entirety.
