Succession Cause / Ruling on Application for Revocation of Grant

  1. 1 Whether the grant of letters of administration should be revoked for lack of consultation with all beneficiaries.
  2. 2 Whether the sale of a portion of the estate to a third party prejudiced the rights of the objector and other beneficiaries.
  3. 3 Whether the interests of the second house were adequately considered in the distribution of the estate.

Ratio Decidendi

The court found that although the objector and his siblings were not initially consulted, the petitioner had disclosed all beneficiaries and proposed an equal division of the estate between the two houses. The objector and his family were now aware of and content with the portion allocated to them. The sale of a portion of land to the interested party was deemed to have come from the first house's share and did not prejudice the second house. As the interests of the second house were adequately considered and no material concealment or fraud was established, there was no basis for revocation of the grant. The application for revocation was therefore rejected.
