The court found that there was an error in the confirmed grant and subsequent orders, which had bundled together Kathiri M'Murithi and her son Peter Murithi as beneficiaries of the deceased's share in LR No Nyaki/Kithoka/690. The error originated from the petitioner's own pleadings and supporting documents, which incorrectly listed Peter Murithi as a son of the deceased. Upon clarification, it was established that the property was jointly owned by the deceased and Kathiri M'Murithi, and that the succession cause should only affect the deceased's share. The court held that it is untenable in law to distribute the share of a surviving joint owner through the estate of the deceased....
