Procedural Posture

Succession Cause / Ruling on Applications for Reasonable Provision and Confirmation of Grant

  1. 1 Whether the property known as Nairobi Block 97/567 (Tassia Embakasi) forms part of the deceased's estate or passes to the surviving joint tenant by survivorship.
  2. 2 Whether the 1st Applicant is entitled to reasonable provision from the deceased's estate under Section 26 of the Law of Succession Act.
  3. 3 Whether the 1st Applicant has a beneficial interest in Karen Land Parcel Number 2259/214 acquired during marriage.

Ratio Decidendi

The court held that Nairobi Block 97/567 (Tassia Embakasi), being jointly owned by the deceased and the 1st Applicant, did not form part of the deceased's free estate and passed solely to the 1st Applicant by operation of the doctrine of survivorship under Section 49 of the Land Act. The deceased could not bequeath this property in his will. Regarding Karen Land Parcel Number 2259/214, the court found that it was acquired during the marriage between the deceased and the 1st Applicant, and that she made some financial contribution to its development. Consequently, the 1st Applicant was entitled to a one-third share of the Karen property, with the remaining two-thirds to the 2nd Respondent....
